(FEDCUTA)
CONSTITUTION
(As amended by the National Executive Meeting)*
I. NAME
The Federation shall be known as the Federation of Central Universities’
Teachers’ Associations hereinafter referred to as “the Federation” or (FEDCUTA).
II.
MEMBERSHIP
(i) Membership of the Federation shall be open to all Teachers’ Associations of
the Central Universities. Not more than one Teachers’ Association shall be
enrolled as a member of the Federation.
(ii) Every Association intending to be a member of the Federation shall apply
for the same in the prescribed form along with a draft of the prescribed annual
fee to be determined by the National Executive Committee of the Federation from
time to time, and shall be enrolled as a member of the Federation.
(iii) The membership fee shall be Rs. 2500/- p.a. However, the same can be
raised, if necessary, from time to time, as per the decisions of the National
Executive.
III.
OBJECTIVES
(i) To advocate, secure, maintain and safeguard the rights and liberties of the
teachers and to help the teachers to fulfill their academic and social
obligations.
(ii) To suggest, initiate and work for suitable legislation affecting
educational policy with special reference to rights and responsibilities of
teachers.
(iii) To promote democratic functioning of the Central Universities, especially
in terms of elected teachers’ participation in decision-making process.
(iv) To take necessary steps to improve the conditions of service of teachers of
the Central Universities.
(v) To promote studies and discussion of academic matters.
IV.
POWERS AND FUNCTIONS
(i) The Federation shall be competent to delegate any or all of its powers
subject to any of its constituent members.
(ii) The Federation, through appropriate authorities, shall have the power
inter-alia:
(a) to take up on request the issues of its members with the MHRD and UGC on
their behalf;
(b) to hold, own or dispose off real and moveable property in trust or otherwise
received or acquired for the furtherance of the abovementioned objectives (above
named), or any of them;
(c) to accept donations in money or in kind, in trust or otherwise, for the
above-mentioned objectives (above named) or any of them, provided that no
donation which is expressly intended to promote any sectional activity shall be
accepted;
(d) to initiate and/or cooperate in any enterprise pertaining to the advancement
of the objectives of the Federation, which in the opinion of the Executive
Committee of the Federation appears appropriate and advisable;
(e) to review, approve and sanction any changes in the Constitution of the
Federation, subject to such procedure as may be provided for in that behalf by
the Constitution or the rules under which the Constitution as may become
necessary from time to time.
V.
THE AUTHORITIES OF THE FEDERATION
(i) The National Executive (hereinafter referred as executive) of the Federation
shall be the Supreme Authority of the Federation.
(ii) Under the Executive of the Federation, there shall be a Secretariat of the
following Office Bearers of the Federation:
(a) A President
(b) Two Vice-Presidents
(c) A Secretary
(d) A Joint Secretary
(e) A Treasurer
(iii) For day-to-day functioning, the members based in Delhi may hold meetings
and take appropriate decisions, particularly in emergency situations. However,
these decisions have to be placed before the National Executive for
ratification.
VI.
NATIONAL EXECUTIVE COMMITTEE
(i) The National Executive Committee shall consist of the Presidents and
Secretaries, or two nominees, of all member associations. Outgoing President and
Secretary, by name, to remain ex-officio members of the Executive for two-year
term.
(ii) The Executive Committee may meet as and when necessary but shall meet at
least twice a year, including the annual meeting. The agenda of the meeting of
the Executive Committee shall be circulated so as to reach the members at least
fifteen days in advance.
(iii) An annual meeting of the Executive Committee shall be held towards the end
of a calendar year or on a date to be decided by the Executive Committee and
shall have on its agenda the consideration of the following item:
(a) The annual report of the Federation prepared by the Secretary.
(b) Statement of accounts by the Treasurer.
(iv) The Executive Committee may convene a special meeting whenever it deems
fit, and after giving due notice, as decided by it.
(v) The meetings of the Executive Committee will be convened by the Secretary of
the Federation with the concurrence of the President of the Federation as and
when necessary. The requisitioned meeting of the Executive Committee shall,
however, be convened within one month from the date of receipt of requisition
specified by it on the receipt of a requisition in writing, signed by not less
than 1/3rd of the members of the Executive Committee.
(vi) The Executive Committee may in some exceptional cases on the
recommendations of the Secretariat and as per the procedures accepted by the
Executive Committee, decide to approve of its proposals through circulation to
all members.
VII.
POWERS AND FUNCTIONS OF THE SECRETARIAT
(i) The President will lead the FEDCUTA delegations in negotiations at various
levels and may decide the members of the delegation in consultation with the
other office bearers.
(ii) The President shall preside over the meetings of the Executive Committee
and the Secretariat, the latter shall consist of all six office bearers.
(iii) The Vice-President shall assist the President in the discharge of his
duties and share such other responsibilities as the Executive Committee may
assign.
(iv) The Secretary shall convene meetings of the Executive Committee and
Secretariat with the concurrence of the President; shall keep minutes of these
meetings; and shall prepare the annual report of the Federation.
(v) The Joint Secretary shall assist the Secretary in the discharge of his
duties and share such other responsibilities as may be assigned by the Executive
Committee.
(vi) The Treasurer shall maintain the accounts of the Federation and prepare the
annual financial report and the budget of the Federation and share such other
responsibilities as the Executive Committee may assign.
(vii) The Executive shall have the power to take decisions in emergency
situations. However, decisions thus taken should be immediately brought to the
notice of the members.
VIII.
ELECTION
(i) The Secretariat and the Executive Committee of the Federation will be
elected by the National Executive with three positions i.e. President, Secretary
and a Treasurer rotating Delhi-based members and the other three positions i.e.
two Vice-Presidents and a Joint Secretary rotating among outside Delhi members.
They shall hold office for a period of two years. (Words “in accordance with a
roster ....shall be placed at the bottom of the roster” stand deleted.)

(ii) The rotation will be done among the member association universities. (Words
“The roster shall consist of members association universities” stand deleted).
(iii) Every second year, at least three months before the term of the current
Executive is to end, the Nation Executive will elect the new Executive. (Words
“Every year according to... host the Federation” stand deleted).
(iv) The entire clause “The Host association ... to do so the same the next
year” stand omitted.
IX.
VOTE OF NO CONFIDENCE
(i) Vote of no confidence against the office bearers / Secretariat members
of the Federation may be moved in the meetings of the Executive Committee.
(ii) Vote of no confidence can be passed by two-third of the majority of the
members of the Executive Committee present and voting, provided that the members
of the Executive Committee present are not less than a half of the total
membership.
X.
VACANCIES
The vacancies shall be filled by the National Executive on the recommendations
of the host association for that particular post. (Words “The nominees of the
President ... shall be filled by the nominating associations” stand deleted.)
XI.
AMENDMENT OF CONSTITUTION
(i) Amendment in the Constitution may be made at a special requisitioned meeting
of the Executive Committee. These changes shall be subject to ratification by
the supreme bodies of the member associations.
(ii) Not less than three months notice shall be given for the consideration of
any such amendment in the Constitution.
(iii) Changes in the Constitution can be made only by a two-third majority of
the members present at the Executive Committee meeting provided that the latter
is not less than a majority of its total membership.
XII.
QUORUM
(i) The quorum for a meeting of the Secretariat shall be at least one
half of the total membership.
(ii) The quorum for a meeting of the Executive Committee shall be one-third of
the number of its members.
XIII.
TERM
The term of the office bearers will be two years.
XIV.
YEAR
The year shall be from 1 January to 31 December.
